I thought that it was made specifically for the game and never publicly released, but I’m not positive on that.

The Mario sprites were originally made by FanGuy for his (sadly) unfinished game, Mario's Mansion Perfect Collection (link). They have yet to be released on public (at least not on MFGG). I think @DJ Yoshiman got permission from FanGuy to use his sprites. Getting in contact with FanGuy would be quite a challenge (is Yoshiman even still in touch with him?), but as far as I remember, the game doesn't say anything about whether the sprites can be used, not even in a README file. Keep in mind that it's been over a decade and a half since the game's demo was released.

I think FanGuy wouldn't really complain if you used his sprites without permission (but don't take my word for it). When Vitiman was continuing Mario's Mansion 3, I haven't seen FanGuy coming back to say anything about it. There's a tool hosted on MFGG that lets you look at sprites from games made with old Clickteam products, which is helpful for ripping (plus you can see sprites of Luigi, Peach, and even an updated FanGuy): https://mfgg.net/index.php?act=resdb&param=02&c=6&id=27419

Thanks for that answer, you pretty much nailed it. I'm not in touch with him, I tried some time ago, but I haven't the foggiest how to even potentially find him. We only knew him from his online alias, which he doesn't use anymore, apparently. Shame, he had some great art!

I would definitely say, if you're going to use them, give him credit, no doubt.
