So after I saw Super Mario Bros. Wonder's trailer, I got the idea to make a fangame with it's art style (but pixelated). I thought it would be nice to have an improved Super Mario Maker with more elements from other Mario games. As I have seen, Nintendo doesn't go (very often) after fangames that aren't remakes.
My game will have 0 assets from Nintendo games, all srites, music and code will be made by me or by my team. So, would this be considered a Mario Maker remake or something? I will add more features such as a store where you can buy exclusive elements and other stuff, but I'm afrait of it being taken down because it will take a lot of work.
Should I do it? Any recommendations to avoid "plagiarism"?

Heavily doubt it from what you've described. As long as it doesn't get too close for comfort you should be fine.

It might help if you don't make the UI too similar as well.

I don't believe making a Mario fan game with a level editor automatically makes it a Super Mario Maker clone. I am the creator of Super Mario Construct which is also a Mario level designer, but it's got a much different philosophy. SMM focuses mainly on ease-of-use by keeping the amount of content simple and small to cater to casual level designers, but this goes at the cost of introducing a lot of limits to what the level designer can do.

Meanwhile most Mario fan-editors out there are vastly different in that regard, they're more expansive and you have much more freedom with what you can do with your levels, but that comes at a cost of the level editor having a bit of a learning curve.

There are some Mario fan-editors that do intentionally try to mimic the appeal of Super Mario Maker though, intentionally making the UI similar and branding themselves as a PC Mario Maker. That's fine by me, but I would recommend staying clear of that direction since there are already a lot of SMM fangames out there.

I see you and other user said I'd have to make a different user interface, I don't think it will be so hard but there are many and not many ways to display an item selection at the same time (without looking like the official games). Anyways, thanks for the comment!

You'll be fine, I guarantee it. There's some phenomenal level editors out there, some of which existed long before SMM. Heck, if you go to the MFGG Hall of fame for the most recent years you'll see a fantastic example, "Yoshi's Fabrication Station". One of my favorites as a young'un was Mario Builder, which is sufficiently aged that the link I provided is an Internet-Archive link.

If the Nintendo Ninjas are willing to let these things fly, I imagine you'll be more than OK. It's actually surprisingly uncommon for Ninty get aggressive with fangames unless they're a production-grade remake (like AM2R was) or Papa Shigeru woke up on the wrong side of the bed.

In addition to what others said, I'd also like to point out Hello's Mario Editor. It has some similarities to SMM, such as the title font and website design. It was pretty popular and had a lot of user-submitted levels. However, it didn't get taken down by Nintendo, probably because it has plenty of unique aspects, such as the UI, some enemies and power-ups, and the ability to mix different types of terrains. It probably wasn't too popular, though. Contrast that to Super Mario ReMaker, a level editor that's so popular it even got a Kotaku article (something that Mario Editor doesn't seem to have). It very much resembles SMM, in areas like the UI, graphics, name, and features. It may have a few new features, such as You vs. Boo races, but despite that the YouTube videos and download links were taken down by Nintendo. All of this should show that it's okay to make a Mario level editor, but not a Super Mario Maker clone. From what you've described, it sounds like you're making a level editor that's focusing on providing elements absent in SMM and using completely new assets, so I think you'd be good.

I see... Well, I think I'm ready now, I have a different UI displaying all the elements in a scroll bar instead of sections like the original games and I'll add new features, but also I'll bring back some from the Mario Makers (I mean, they have the essential elements)
Edit: Can I add online levels and the 100 Mario Challenge?

Well, Mario Editor sorta has those too, although online levels have to be downloaded from the website. I don't remember if you actually start with 100 lives, but I remember there's a mode where you play a bunch of levels one after another (much like 100 Mario Challenge). As long as it doesn't look too similar to Super Mario Maker, you should be good. Smile
