Anyone can make a dang good fangame, you just have to get to know the very crucial Three Rules of Fangame (and Land) Development:

• 1) Wear Winter Clothing When Making Winter Levels - This one's pretty self-explanatory, I feel. If you're gonna make cold levels, you have to prepare for the cold weather! I don't care if inside it's a blistering 150 degrees central heated Rio hotel lounge, you gotta dress appropriately when making any and all chilly levels in your game!
  
• 2.) Is This Text Smaller For Anyone Else? - Guys, I don't think the bold's working right. Is it getting smaller with every successive thing? Will this show up fine when I make the post? Who knows! Yes, this qualifies as a major fangame development rule. Heed my warning.
  
• 3.) Floss After Every Meal - This one's just common sense. Unless you want cavities early on there sport, you better do some serious flossing. Okay, so there isn't actual conclusive proof that flossing improves dental health, but like I care. There's simply no better way to get rid of gunk and stuff!
  
• 4.) What Okay Now It's Back To Being Bolder - I really don't get MyBB's text editor right now, it's bugging out in increasingly bizarre ways. It's really preventing me from organizing the three (now four) rules of fangame development.
  
• 5.) Don't Sell Your Fangames - Give them away for free instead. Be charitable! No-one likes someone who's stingy with their fortune. Everybody loves a philanthropist.
  
• 6.) Remember That Video Games Aren't Real - I've had manic episodes where I couldn't tell, either. Don't worry, it happens to everybody. Just remember that Mario won't come out of the TV at night to steal your precious dairy products. Get your own MILK, MARIO.
  

So there you go, the now 6 absolutely CRUCIAL rules to fangame (and land) development. I hope you learned something today, and no: you can't go to jail for making fangames, silly! Jail is for adults! Pfft, you'll go to Juvenile Detention Center instead, duh.

Sorry your friend is hard to convince there, mate. There's not much else anyone can do to assure him, and it sounds to me like he just wants a reason to not actually work on anything. Remember: if it always seems like there's something in the way with someone, there's a good chance they're putting up the obstacles themselves.

There's not much else we can say to help your friend. If he's too scared to make a Mario game then just let him not make a Mario game. Once you've told him that there won't be any severe consequences you've done all you can, so just let it go and talk to him about other things.

(Late reply!) I mean't to say, ''My friend wondered if you would forget to listen to nintendo's fangame rules''. However my friend might still be upset at nintendo so that we understand the big issue. Isn't there another way to solve this issue?

The worst that could happen, assuming he does not make money from the project, is Nintendo asking him to stop production on his game, but that is unlikely.

According to Friendly Dictator he says 99% of the people who make fangames here haven't gotten in trouble, perhaps that sounds different than what others say, i thought that depends if you just make fangames...
