Sometimes, people say tongue-in-cheek things! Sometimes they even say such things on the Internet!
As others have mentioned, fangaming is in a legal gray area. A random Nintendo customer support representative probably can't officially give your friend permission to make a fangame, but Nintendo probably isn't going to care (or even notice) unless he's making a 1:1 remake of an official Nintendo game or trying to monetize his work. If it bothers you that fangaming is in a gray area, you can always make an indie project instead - MFGG has plenty of resources you could use for a "Mario clone" or other indie project.
