None of this is for profit, right? It's all content that we, as the Mario fangaming community, create, right? For no money, just for fun and the joy of creation?
We're "stealing" the characters we use, we're "stealing" the original compositions when we re-compose them, we "steal" graphics and audio directly from Nintendo games all the time, sometimes by decompiling them. Unless somebody is profiting from this somewhere, I'm not sure I see the issue.
Also, I used that coin sound effect to prove a point, I obviously don't care if someone uses it without permission or not.
Edit: Oh yeah they make a profit out of the stolen assets too, but even if they didn't this wouldn't be completely ok.
